The Position

The municipality of Zuidplas is looking for an experienced and independently working enforcement lawyer. To ensure the continuity of work, we are looking for an experienced lawyer to strengthen our team for at least 3 months until the permanent enforcement lawyer has been recruited and started. As an enforcement lawyer, you will work on diverse and sometimes complex legal issues within the domain of supervision and enforcement.

You operate at the intersection of legal frameworks, societal interests, and administrative choices.

You analyze cases, advise on the approach, and ensure legally sound and well-substantiated actions.

You are quickly able to find your way within the organization and independently handle ongoing and new cases. From an order subject to a penalty to a closure based on the Opium Act or Municipalities Act: you assess what is legally possible and appropriate and translate this into legally correct, complete, and well-substantiated decisions.

You advise colleagues and the executive board, represent the municipality in objection and appeal proceedings, and are an important legal sparring partner within the team.

Activities

As an enforcement lawyer, you have an independent role and are given the space to manage your own cases. You work closely with supervisors, enforcers, colleagues within the organization, and external partners.

Zuidplas is a young, energetic, and rapidly growing municipality with five villages, strategically located between Rotterdam and Gouda. This location brings a lot of dynamism. • Handling complex enforcement cases. You assess violations, interests, and evidence and, together with involved colleagues, determine the legally appropriate next step. For this, you must not only know what is legally possible but also keep an eye on proportionality, legal certainty, and enforceability, and you know how to weigh different interests.
• Drafting legally sound decisions. This includes orders subject to penalties, orders subject to administrative coercion, violations of waste regulations and physical living environment regulations, collection decisions, and administrative measures, including closures based on the Opium Act or the Municipalities Act.
• Representing the municipality. On behalf of the municipal executive, you speak in objection and appeal proceedings and represent the municipality in court where necessary.
• Collaborating with partners. You coordinate with, among others, the police, supervisors, and other enforcement partners and ensure an integrated approach.
• Contributing to policy and execution. You identify developments in laws and regulations and translate them into daily enforcement practice.
• Sharing your expertise. Within the team, you are an important point of contact for complex legal issues and help colleagues to work legally soundly and carefully.
• A completed HBO or WO degree in Law;
• At least 3 years of relevant work experience with legal enforcement, preferably within a municipality or other government organization;
• Knowledge of administrative law and enforcement, and experience with, among others, the APV, Opium Act, Physical Living Environment Regulation, waste regulations, Environmental Act, and special laws;
• Experience in drafting enforcement decisions;
• Experience in handling objection and appeal proceedings;
• Experience within a municipal or comparable administrative environment;
• You can quickly operate independently within a new organization.
