Assignment

As an enforcement lawyer, you contribute to a safe, livable, and attractive municipality. You handle legal issues and enforcement files in the areas of environmental law, the APV (General Municipal By-laws), and special laws, ensuring that the municipality can act carefully and legally soundly in cases of violations. You will work on diverse files that are directly visible in society.

You advise supervisors, permit issuers, and administrators on the use of administrative enforcement instruments. You assess enforcement requests and draft legal correspondence and decisions. You have knowledge of the subsequent objection and appeal procedures. You can translate complex legal issues into clear advice and practical solutions that are legally and administratively sound.

Within this role, you work closely with colleagues from permit issuance, supervision, enforcement, and public order and safety. You are a substantive sparring partner, mindful of the various interests involved, and make a significant contribution to careful decision-making and effective implementation of municipal enforcement policy.

The assignment requires an enforcement lawyer who combines legal quality with administrative sensitivity, a practical approach, and the ability to proactively manage (complex) files.

Responsibilities

The activities include:

The enforcement lawyer carries out the activities within the existing municipal organization and the applicable work processes, policy frameworks, and administrative responsibilities. The activities are performed in close coordination with supervisors, enforcers, permit issuers, management, and administration, with the enforcement lawyer being part of the regular file handling and municipal decision-making. Prioritization and handling of files take place within the frameworks and planning set by the municipality.

Profile of the suited interim professional:

• Advising supervisors, enforcers, permit issuers, and management on the legal approach to specific files, including unsolicited and at an early stage.
• Drafting and assessing warnings, preliminary notices, penalty orders (lasten onder dwangsom), orders for execution (lasten onder bestuursdwang), recovery decisions, collection decisions, tolerance decisions, closure decisions, and other dispositions.
• Assessing violations and the legal options for enforcement action.
• Analyzing research data, supervision reports, and other evidence, and ensuring a legally sound file.
• Advising on the use of administrative enforcement instruments and the strategy to be followed in (complex) files.
• Drafting clear administrative advice, memos, and decision-making documents for the mayor and council, with a concrete assessment of legal risks, courses of action, and actionable advice.
• Translating developments in legislation, policy, and case law into municipal implementation practice.
• Completed WO Master's degree in a legal field;
• Minimum 4 years of demonstrable work experience in the past 8 years as an enforcement lawyer or legal advisor in the field of APV and/or VTH (Permitting, Toezicht, Handhaving
• Permitting, Supervision, Enforcement) within a municipal organization;
• Demonstrable work experience in an advisory role to supervisors, enforcers, permit issuers, and management;
• Demonstrable work experience in translating legislation and policy into implementation;
• Minimum 2 years of demonstrable work experience in the past 5 years in independently drafting enforcement decisions and experience with objection and appeal procedures;
• Demonstrable work experience with legally, administratively, or socially complex enforcement files.
