For the municipality of Maashorst, YER is looking for a Senior Planning Law Specialist for complex spatial procedures.

The Position

Background and Context

The municipality of Maashorst is involved in several complex spatial developments and procedures where the Omgevingswet, administrative ambitions, and diverse interests converge. A portion of these dossiers requires specialist planning law knowledge and experience in complex and stalled spatial procedures, legal strategy, objections, legal proceedings, and administrative and inter-administrative coordination.

This specific combination of knowledge and experience is not sufficiently available within the organization for the relevant dossiers. To advance this defined portfolio independently from a legal perspective, additional specialist expertise is temporarily being hired. The municipality is looking for an experienced planning law specialist who can independently analyze, advise on, guide, and, where necessary, restart complex spatial procedures.

This is a temporary assignment where the contractor is responsible for the legal approach, advice, and delivery of agreed-upon results based on their own expertise.

The Assignment

At the start of the assignment, the contractor will be given a portfolio of complex spatial plans and procedures designated by the client.

Intended Result

The result of the assignment is that the complex spatial dossiers agreed upon at the start have demonstrably progressed from a planning law perspective, and the agreed-upon legal products and advice have been delivered. For each dossier, the aim is to work towards a clear legal course of action and, depending on the dossier's phase, towards a legally soundly prepared next step, procedure, decision-making, or completion.

The deployment of specialist expertise should contribute to the careful and efficient progression of the relevant spatial procedures and the removal of planning law obstacles where possible within the applicable legal frameworks.

Nature of the Assignment

The assignment requires an experienced specialist who can independently understand complex issues and arrive at advice and results based on their own professional judgment. The municipality is explicitly seeking specialist expertise for a temporary and defined task. The contractor will be evaluated on the quality and timeliness of the agreed-upon results and products and is independently responsible for how these results are achieved within the agreed frameworks.

• Analyzing the planning-legal situation and advising on an appropriate legal approach;

• Legally guiding and advising on parts of spatial procedures;

• Where necessary, representing the client in legal proceedings before the court concerning the spatial plans designated within the assignment;
• Delivering legally soundly prepared and transferable dossiers and advice.
• Extensive experience with complex and legally challenging spatial procedures;
• Experience in analyzing and restarting procedures where legal, administrative, and substantive bottlenecks converge;
• Independently determining and advising on the legal strategy within complex spatial dossiers;
• Extensive experience with objections, appeal procedures, and, where applicable, representation before the administrative court;
• Experience with complex changes to the environmental plan and BOPA procedures under the Omgevingswet;
• Demonstrable experience with administrative and inter-administrative coordination and negotiation with, among others, the province, water board, and other partners;
• The ability to independently translate legal risks, courses of action, and solution directions into concrete products and decision-making.
• Competitive fixed salary, depending on knowledge and experience;
